In UN news:

  • Amid rising humanitarian needs worldwide, the UN’s sexual and reproductive health agency, UNFPA, on Tuesday, December 13th, launched a $1.2 billion appeal to support 66 million women, girls and young people in 65 countries affected by crisis. The 2023 Humanitarian Action Overview is UNFPA’s largest appeal ever and includes $289 million in Afghanistan, $70 million in Ukraine, $62 million in Somalia, and $23 million in Haiti. Read more here.
  • In Somalia, a full-blown famine has been narrowly averted for now, but the hunger emergency has not gone away, UN humanitarians said on Tuesday, December 13th. In an update on food insecurity in Somalia, the UN Office for the Coordination of Humanitarian Affairs (OCHA) said that famine had been avoided because host communities and relief teams had helped those in most need. Despite their efforts, food insecurity remains “catastrophic”. For more information, access this article.

  • Today’s “trying times” highlight the need for a recommitment to human rights, which are central to solving global problems, UN Secretary-General Antonio Guterres said in his message for Human Rights Day on Saturday, December 10th. The annual commemoration celebrates the UN General Assembly’s adoption of the Universal Declaration of Human Rights on 10 December 1948. “Human rights are the foundation for human dignity, and the cornerstone of peaceful, inclusive, fair, equal and prosperous societies,” said Mr. Guterres. • Some 20 million jobs could be created by investing in policies that support nature and address climate change, disaster risk, food insecurity, and other major challenges, according to a UN report published on Friday. Launched by the International Labour Organization (ILO), UN Environment Programme (UNEP) and International Union for Conservation of Nature at the UN's Biodiversity Conference (COP15) in Montreal, theÔÇ»Decent Work in Nature-based Solutions report underscores the need for greening the economy in a way that is fair and inclusive, creating meaningful work opportunities for all. Read more here.

  • The adoption by most nations of the world of the UN Convention on the Law of the Sea 40 years ago, was a “vital step to bring governance and order” to the vast collective treasure that is the ocean, said the UN chief António Guterres on Thursday, December 8th. “The ocean is life. The ocean is livelihoods and the ocean binds humanity together across history and cultures”, said the Secretary-General, at a major General Assembly meeting marking the 40th anniversary of the adoption of the Convention. How States Use the UN General Assembly to Create International Obligations

Last Wednesday, December 7th, we were privileged to virtually host Professor Rossana Deplano, who directs the Centre for European Law and Internationalisation at Leicester Law School, for a discussion on her new book Empirical and Theoretical Perspectives on International Law: How States Use the UN General Assembly to Create International Obligations (Cambridge University Press 2022).

In discussion with SIPA Professors Yasmine Ergas and Daniel Naujoks, Professor Deplano explained how states attribute legal significance to resolutions in three different contexts: at the time of adoption, within domestic law and in international practice. Her findinds indicate that, contrary to the existent theories on the legal significance of resolutions, the General Assembly is not a unitary actor. She also demonstrated that the concept of legal significance of resolutions is not predetermined or static. While resolutions are often framed in normative language, they acquire legal significance only to the extent that states find it desirable or convenient, depending on context and circumstances.
